Penalties dealt out in court




Four motions to revoke probation and four guilty pleas were heard in 115th District Court in Gilmer last week (first week of July).

Motions to revoke probation included one man who pled true to the state’s allegations of sexual assault of a child, a second-degree felony.

He was Shaun Eric Christy, 27, of Gilmer. He received 18 years in prison.

Upshur County District Attorney Billy Byrd was prosecutor, and Tim Cone was defense attorney.

Other motions to revoke probation, all of whom also pled true to the state’s allegations, included:

• Michael Shane Reeser, 32, Gilmer, robbery, a second degree felony. He received seven years in prison. Byrd was prosecutor, and John Eastland was defense attorney.

• Marie Baughn, 25, Gilmer, attempted possession of a controlled substance, a Class A misdemeanor. She received 60 days in the county jail. Assistant Upshur County District Attorney Robert L. Cole Jr. was prosecutor, and Matthew Patton was defense attorney.

• Terry Leonard Bircher, 42, Winona, posession of a controlled substance-cocaine, a state jail felony. He received nine months in a state jail. Byrd was prosecutor, and Charles Van Cleef was defense attorney. Guilty pleas included:

• Shedaria L. Owens, 28, Arlington, theft of property worth between $1,500 and $20,000, a state jail felony. She received two years in a state jail, probated for five years.

In addition, she was ordered to pay $4,159 in restitution pay other costs and fees, and perform 250 hours of community service. Byrd was prosecutor, and David Griffith was defense attorney.

• Sarah Collins, 40, Pittsburg, arson, a second-degree felony. She received seven years deferred adjudication probation. She ordered to pay $1,000 in restitution, a $1,000 fine, and to pay other costs and fees and to perform 300 hours of community service. Cole was prosecutor, and Matthew Patton was defense attorney.

• Fornice Cary Baotner, 17, Gillmer, burglary of a habitation, a second-degree felony. He was sentence to seven years deferred adjudication probation. He was also ordered to pay $2,020 in restitution, other coss and fees, and write a letter of apology to the victim within 30 days. Byrd was prosecutor, and Cone was defense attorney.

• Michael Ray Minter Sr., 476, Gilmer, theft of property between $1,500 and $20,000 in value, a state jail felony. He received 18 months in a state jail. Cole was prosecutor, and Dwight Brannon was defense attorney.
